By using Ardzen (“the Platform”), you agree to adhere to and be bound by these Terms of Service. If you do not agree with these terms, please do not use the Platform.
2. User Accounts
2.1 Registration
To access certain features of the Platform, you must create an account. You agree to provide accurate and complete registration information and to keep your account information current.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect any unauthorized use of your account.
2.3 Age Restrictions
The Platform is not intended for use by individuals under the age of majority as defined by the laws of your country or Canada, whichever is higher.
2.4 Account Review
The Platform does not conduct background checks or endorse any users. The Platform is not responsible for the reliability, accuracy, or completeness of any information provided by users.
2.5 Account Password
You are responsible for safeguarding your password and any actions performed under it, whether with our Platform or a Third-Party Social Media Service. Do not disclose your password to any third party and notify us immediately of any security breach or unauthorized use of your account.
3. User Conduct
3.1 Prohibited Activities
Users must not engage in:
- Posting false, misleading, or deceptive content.
- Selling counterfeit, stolen, or illegal goods.
- Harassing, abusing, or harming other users.
- Violating any laws or regulations.
- Interfering with the operation of the Platform.
4. Listings and Transactions
4.1 Listing Items
When listing an item for sale, you must provide accurate and detailed information about it and ensure it complies with all applicable laws and regulations.
4.2 Prices
Sellers set item prices on Ardzen. The Platform does not control or influence these prices.
4.3 Transaction Terms
The Platform serves as a venue for buyers and sellers to negotiate and complete transactions. The Platform is not a party to these transactions and does not assume responsibility for the items sold or disputes that may arise between users.
4.4 Payments
Payments can be made through various methods available on the Platform, relying on payment gateways with their own terms of service and limitations. If your payment card is not authorized, we are not liable for any delay or non-delivery of your order.
4.5 Service Fees
The Platform may charge fees (and applicable taxes) for certain services, such as listing items, commissions, or transaction processing. All fees are non-refundable unless stated otherwise. Users are responsible for paying all applicable taxes. We reserve the right to change service fees at any time.
4.6 Shipping
Ardzen partners with Aftership for shipping facilitation. Sellers are responsible for packaging, shipping, and deliveries. Ardzen is not liable for any shipping and delivery issues between buyers and sellers.
5. Refund Policy
All sales on the Platform are final. The Platform does not offer refunds or returns for items sold.
Buyers and sellers should communicate directly to resolve any transaction issues. A buyer may open a case with Ardzen if their purchase was not received or if the item received was misrepresented and Ardzen shall assist the parties in resolving the dispute.
6. User Content
6.1 Ownership
You retain ownership of content you post on the Platform but grant the Platform a non-exclusive, worldwide, royalty-free license to use, modify, and display your content in connection with the Platform’s operation.
6.2 Content Standards
Content must not be illegal, offensive, or infringe on the rights of others. The Platform reserves the right to remove any content violating these standards.
7. Privacy
Your use of the Platform is subject to our Privacy Policy, which details how we collect, use, and protect your information.
8. Disclaimers and Limitation of Liability
8.1 No Warranty
The Platform is provided “as is” without any warranties. We do not guarantee the accuracy, completeness, or reliability of any content or services on the Platform.
8.2 Limitation of Liability
To the fullest extent permitted by law, the Platform is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
9. Indemnification
You agree to indemnify and hold the Platform harmless from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms of Service, or your infringement of any rights of another.
10. Changes to Terms
We may modify these Terms of Service at any time. Changes are effective upon posting to the Platform. Your continued use of the Platform indicates acceptance of the revised terms.
11. Termination
We may terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct violating these Terms of Service or harmful to other users or the Platform.
To terminate your account, discontinue using the Service, delete your account, or contact us for assistance.
12. Governing Law
These Terms of Service are governed by the laws of Canada. Any disputes will be resolved in the courts of Canada. International users must comply with local laws applicable to their use of the Platform.
